The Supreme Court of Texas held that the U.S. Supreme Court opinion recognizing the right of same-sex couples to marry does not automatically entitle them to spousal employment benefits. The unanimous court held that the 2015 opinion in Obergefell v. Hodges did not address the right to tax, insurance, or other benefits–only the right to marry.
The Supreme Court of Texas heard oral arguments today in a case where Houston taxpayers sued urging that subsidizing employment benefits for the spouse of a same-sex couple is illegal. Lawyers for the taxpayers describe the case as “the only one of its kind in the nation.”

Two Texas state senators have pre-filed a bill which is intended to protect the religious liberty and First Amendment freedoms of clergy in the Lone Star State. Pastors have been under attack in Texas and their sermons sought to be compelled during litigation by a government unit. The pastors were in a fight over a transgender bathroom ordinance at the time they were subpoened.

HOUSTON, Texas — The head of a national and state pastors organization based in Houston said, “I can’t believe I’m saying this, but Georgia’s demand is even worse than when the Mayor of Houston demanded 17 different categories of materials, including sermons, from the seven of us.” The pastors say they are outraged about the State of Georgia asking for copies of a pastor’s sermons in litigation there.
Two taxpayers filed a motion for rehearing with the Texas Supreme Court on Monday to reconsider their order denying review of a case against the openly gay former Houston Mayor and the City of Houston. They urge that Mayor Annise Parker violated the Texas Constitution and state statutes when she gave spousal benefits to gay employees in 2013 and 2014. Parker issued these benefits to employees prior to the U.S. Supreme Court’s same-sex marriage ruling.
A city council in a Dallas suburb has rejected a proposal by its mayor to adopt a proposal to use birth certificates to determine what bathroom people use. The ordinance is similar to a law passed in North Carolina and was aimed to address the use of women’s restrooms by men.

The Post’s “A perverted campaign against LGBT rights in Houston,” assaults ads shown in Houston, Texas, opposing a city ordinance that has been dubbed “the bathroom ordinance.” The author writes, “What goes too far is this bigoted ad and its perversion of the facts. It is an outright lie to say ‘any man at any time could enter a woman’s bathroom at any time simply by claiming to be a woman that day.’ Such a statement reveals a willful ignorance of what it means to be transgender.” The ordinance has been submitted to the voters in Houston during the city’s November election. HOUSTON, Texas — Houston Texans owner Bob McNair, and former Houston Astros and six-time MLB All-Star player Lance Berkman, are opposing an ordinance that would allow transgendered men to use women’s restrooms in Houston.
