Former New Orleans Saints defensive end Will Smith’s blood-alcohol content was three times the legal limit on the night he was shot, according to sources quoted by NOLA.com/The Times-Picayune.
Those sources claim Smith’s blood-alcohol content was 0.24, which is three times the legal limit of .08.
According to NOLA.com/The Times-Picayune, the sources spoke in light of “toxicology results,” which have yet to be released to the public. “Peter Thomson, an attorney for the Smith family, did not immediately return messages Tuesday seeking comment on the toxicology results.” ESPN quotes sources putting Smith’s blood-alcohol content at “0.235.” That is .005 lower, but still “nearly three times the legal limit.”
Cardell Hayes, 28, was charged with second-degree murder for allegedly shooting Smith to death on April 9. The shooting occurred after “chain-reaction crash in which Hayes’ Hummer struck the Smiths’ SUV on Sophie Wright Place near Felicity Street.” Hayes claimed he shot Smith in self-defense.
Breitbart News previously reported that police located a loaded semiautomatic handgun in Smith’s car after the incident.
Two days after the shooting Saints head coach Sean Payton disparaged private gun ownership and made clear his hope that Smith’s death would lead to more gun-control laws. USA Today quoted Payton saying, “I hate guns.” He dismissed arguments for gun ownership for self-defense purposes as “madness.”
