On August 14 Judge Nina Pillard dismissed Maricopa County Sheriff Joe Arpaio’s case against President Obama’s immigration policies–specially against the “Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA)” and the Deferred Action of Childhood Arrivals (DACA).
Pillard is an Obama appointee who sits on the U.S. District Court of Appeals for the District of Columbia.
According to CNN, DAPA allows “4.3 million otherwise removable undocumented immigrants to be eligible for work authorization and associated benefits” and DACA is “a program that allows non citizens who were brought here as children to apply for work authorization and protection from deportation for three years.” Obama used executive actions to expand DACA in November 2014.
Arpaio argued that DAPA and DACA both “inhibit his ability to perform his job,” especially the aspects of his job pertaining to immigration in Maricopa County.
But Judge Pillard ruled that Sheriff Arpaio “failed to allege an injury that is both fairly traceable to the deferred action policies and redressable by enjoining them.” She pointed out that while “the Sheriff’s Office’s expenditures of resources on criminal investigation, apprehension and incarceration of criminals are indeed concrete,” she believed his contention that DAPA and DACA will unduly impact the execution of his duties was “unduly speculative.”
The White House responded to the ruling by issuing a statement:
The court correctly recognized that the Constitution does not permit federal courts to hear lawsuits that rest on baseless speculation. We will continue to work toward resolving the legal challenges so that the administration can move forward with implementing all of the president’s common sense immigration policies.
