On July 22, Gabby Giffords suggested there is yet another gun control loophole, and it is found in the lack of laws governing gun possession for dating relationships.
This new loophole comes even as Everytown for Gun Safety fights the so-called “background check loophole” and Moms Demand Action seeks laws to address the so-called “online gun sale loophole” the “Charleston loophole,” and the “gun show loophole.”
Giffords wants Congress to act quickly to to broaden domestic violence protections so that they include unmarried couples. This would then open the door for a girlfriend to file charges against a boyfriend whom she feels might be volatile–or against whom she holds a grudge of some sort–and have a judge issue an order barring the boyfriend from purchasing or possessing firearms.
Giffords believes this is the right next step for a country like ours; a country which she says “has a problem with gun violence against women.”
And according to her gun control group–Americans for Responsible Solutions–Giffords thinks the Zero Tolerance for Domestic Abusers Act, sponsored by Representatives Debbie Dingell (D-MI-12th) and Robert Dold (R-IL-10th), is the very bill which all of Congress should rally behind.
The bill will “close the loophole that lets perpetrators of dating violence access guns” and will address yet another loophole as well, by closing what ARS refers to as a “loophole that lets some convicted stalkers access guns.”
Neither Giffords or ARS commented on the June reports surrounding an New Jersey appellate court’s decision upholding the ruling that a southern New Jersey man cannot own guns because his wife is a felon “who’s been accused of domestic violence.” In this case, domestic violence laws that prevent her from being armed were interpreted to deny him Second Amendment rights as well.
On June 20, NBC Philadelphia reported that “the two-judge panel found that the guns’ presence in the man’s home would give his wife greater access to firearms, creating an unacceptable threat to public health, safety, and welfare. They said the man’s Constitutional right to own weapons was ‘subject to reasonable limitations.'”
This is a perfect example of the very real slippery slope which the NRA, Gun Owners of America, and so many others have warned about in the left’s frenzied push to secure gun control under the auspices of fighting domestic violence.
