On February 17, Breitbart News reported that 72-year-old Gordon Van Gilder was facing felony charges for having an unloaded flintlock pistol in his car.
On Wednesday, The Daily Journal reported that charges against Van Gilder had been dropped.
The prosecutor in the case, Jennifer Webb-McRae, announced that the state was exercising “prosecutorial discretion to dismiss” the charges against Van Gilder, but said “the public should be forewarned about the prescriptions against possessing a firearm — even an antique — in a vehicle.”
Van Gilder was originally charged after being pulled over during a routine traffic stop and informing the officer that he had an unloaded gun from the 1700s in his car. If found guilty, the charges against Van Gilder would have meant a minimum of 3.5 years in prison and a maximum of 10.
