On Thursday, Arizona Governor Jan Brewer asked the Supreme Court to stay a ruling that would force the state to issue driver’s licenses beginning next Tuesday to DREAMers who received temporary amnesty under President Barack Obama’s 2012 unilateral Deferred Action for Childhood Arrivals (DACA) program.
On Tuesday, the liberal Ninth Circuit Court of Appeals in San Francisco “denied a request by Brewer to keep on hold that panel’s July ruling against her ban while the state’s attorney general prepares a U.S. Supreme Court appeal.”
According to the Arizona Republic, Brewer’s attorneys argued to Justice Anthony Kennedy “that the case raises issues of constitutional law relating to whether ‘a federal agency’s informal policy memorandum to ignore federal law preempts a long-standing state driver’s license law.'”
There are reportedly 20,000 DREAMers in Arizona who received DACA and would qualify for driver’s licenses. Brewer “announced her ban on driver’s licenses on Aug. 15, 2012, the day deferred action took effect.”
If the Supreme Court does not intervene, “U.S. District Judge David Campbell in Phoenix can issue an injunction that would require the Arizona Department of Transportation to issue driver’s licenses” to DREAMers as early as next week.
