During an April 20th appearance on ABC’s This Week, former justice John Paul Stevens said each of his proposals to change the Constitution – including his proposal to change the Second Amendment – “is a moderate proposal.”
On April 11th Breitbart News reported that Stevens uses his new book, Six Amendments: How and Why We Should Change The Constitution, to argue that we should add five words to the Second Amendment to correct its interpretation – namely to ensure that it is interpreted as a collective right rather than an individual one.
The Second Amendment currently reads:
A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
Stevens want to change it to:
A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms when serving in the Militia shall not be infringed.
During his appearance on This Week, Stevens said the change in the Second Amendment “would merely prevent arguments being made that Congress doesn’t have the power to do what they think is in the best public interest.”
However, as ABC News reported:
The last state militia was disbanded in 1866, so no one would be covered by Stevens’ new amendment. In other words, the government would face no restrictions in its ability to ban or regulate the ownership or use of guns.
