A judge in Fairfield, California has accepted a lawsuit claiming that a pro-life pregnancy clinic was illegally ejected from a building by landlord, according to a press release by Pacific Justice Institute, which represents the clinic.
The suit alleges that a Vacaville landlord agreed to rent space in a commercial medical arts building to non-profit Alpha Pregnancy Clinics. The landlord had Alpha sign the landlord’s standard lease and accept a check for first and last month’s rent from Alpha.
But a few days later, the landlord allegedly breached its lease with Alpha in order to protect a Planned Parenthood facility in the same building. The landlord claims that he backed out because the pro-life clinic was not a good fit in the building.
Alpha stated that it was important to be located in close proximity to Planned Parenthood in order to offer a pro-life alternative and services for women and girls with crisis pregnancies.
The lawsuit seeks specific performance of the rental contract and damages under California’s Unruh Civil Rights Act. Under the lease, Alpha had been scheduled to move into the building on November 15, 2014. The landlord’s breach of contract has also left Alpha in limbo ever since.
The Solano County Superior Court overruled efforts by the landlord to get the case dismissed and the landlord’s attorneys have chosen not to ask for a hearing. It is expected that the case will go to trial in the near future.
