CA Bill Protects Law-Abiding Citizens from ‘Gun Violence Restraining Orders’

On March 17, California’s Assembly Committee on Public Safety will hear Assemblywoman Melissa Melendez’s (R-Elsinore) bill to protect law-abiding citizens from “Gun Violence Restraining Orders” (GVROs).

Breitbart News previously reported that Melendez’s bill–AB 225–would shield law-abiding citizens from false accusations that could lead to the issuance of GVROs against them.

Melendez said, “I did not enact the law creating (GVROs), but I’m awfully happy to be the one to undo it.”

According to the NRA-ILA, AB 225 is a corrective for AB 1014, which was passed in the wake of Elliot Rodger’s May 2014 attack in which he shot three people to death and stabbed to death three others.

NRA-ILA describes AB 1014 as a “deeply flawed” measure that “authorizes a law enforcement officer or an immediate family member of a person to seek, and a court to issue, a GVRO.” The GVRO then allows the temporary confiscation of firearms from the person against whom it was issued.

The bill presents “due process concerns [that] could lead to innocent conduct triggering a denial of rights for individuals who pose no danger to society because of a simple misunderstanding between law enforcement and immediate family members.”

Melendez’s bill protects law-abiding citizens against these due process concerns by making it a felony to falsely file a GVRO complaint. AB 225 makes false filing punishable by two to four years in county jail.
