On Monday’s broadcast of CNN’s “Situation Room,” Senator Ben Cardin (D-MD) expressed confidence that there are more than 67 senators who would disagree with the president declaring a national emergency on the border, but cautioned that those disagreements might not translate into having enough votes to override a presidential veto on a resolution that disapproves of a national emergency declaration.
Cardin said, “I’m confident that there are over 67 senators who disagree with the president using that authority. That may not translate to 67 votes to override a presidential veto. Remember, there’s also the courts. So, I am confident that my colleagues think this is wrong. I think it’s wrong. And I believe the courts would uphold the authority of Congress over the president in this regard.”
