On Saturday’s broadcast of the Fox News Channel’s “Fox & Friends,” Fox News Contributor and George Washington University Law Professor Jonathan Turley stated that it would be a “dreadful idea” if the Democrats investigated Supreme Court nominee Judge Brett Kavanaugh if they re-take the majority in Congress.
Turley said, “It’s a dreadful idea. Indeed, there was something called the dreadful counsel that was used in Medieval times, where you could actually dig someone up and put them on trial. … So, sure, you could have a trial for the dead if you wanted, or the confirmed, but it is a dreadful idea. The framers created this process to have some finality. Now, the Democrats may not like the outcome of the vote, but 50 — over 50 senators are expected to be satisfied with this record and to confirm this nominee. If we’re going to start to do do-overs every time the majority changes, then we will never have a stable court.”
