Former Virginia Attorney General Ken Cuccinelli argued that states along the Mexican border can and should use their National Guards and law enforcement to secure their borders in an interview on “The Laura Ingraham Show” on Tuesday.
He stated that “when they’re coming across your border … Article I, Section X of the Constitution,” allows border states “deal with this [influx of illegal immigrants] themselves.”
Cuccinelli added that the federal government would have little authority to stop the states from securing their borders on their own, saying “the only thing the president could do is federalize the National Guard,” and “there’s nothing the president could do about the Texas Rangers, or state police.”
Host Laura Ingraham expressed her agreement with Cuccinelli’s argument.
“This is why we had militias. This is why militias actually existed,” she added. “That is the definition of despotism. When our chief executive is committed to doing a complete go-around our Constitution.”
Also in his appearance, Cuccinelli criticized Karl Rove, Haley Barbour and others for the tactics used Sen. Thad Cochran’s (R-MS) reelection bid, in which he took on challenger Chris McDaniel for the Republican nomination.
“Scorched earth tactics against your own people have a funny way of not being very fruitful. This is not going away. Mississippi is now a national issue with the grassroots,” Cuccinelli said. “[The establishment] basically sold welfare for votes … What you saw in Mississippi was literally no limits on what they would do to guard their power. It was a new low for the establishment Republicans, and it will have repercussions.”
