Hagel and Administration Claim Clean Prisoner of War Swap

In response to Red Flags Galore on Bergdahl Swap:

We are all in agreement  that this swap between Obama and the radical Taliban Islamists is Fubar. Now Secretary of Offending Americans (Defense) Chuckie Hagel is saying that Obama did not negotiate with terrorists.

Hagel said that the trade was a prisoner swap that is common practice in a war.

Wait.

Did the U.S Congress formally declare war on Afghanistan? I don’t remember that actually happening, so Hagel’s remark that it was a clean prisoner of war swap is just more Fubar.
