Tomorrow, at around 10:30am EDT, the Democrat-left-media complex will launch the most aggressive and sustained attack on the institution of the Supreme Court in the history of our Republic. When the Court throws out at least some portion of ObamaCare tomorrow, President Obama and his partisans on the left and in the media will effectively declare war on the third co-equal branch of government and seek, in every possible way, to undermine the legitimacy of the Court.
They have already tried to lay the groundwork for their attacks. Politico today even unearthed disgraced former Congressman Anthony Weiner to test-drive the coming partisan attacks against the Court. Glimpses of these attacks have been around since oral arguments back in March, but when the reality of the Court’s rejection of Obama’s signature “achievement” becomes clear, the ferociousness of the attacks will be like nothing we’ve ever seen. It bears repeating: the left is willing to destroy the credibility of the Supreme Court in order to defend their policy failure.
ObamaCare was never popular with the public. In fact, it was so unpopular that it sparked a nation-wide grass roots movement that led to sweeping losses of Democrat elected officials at every level of government. Today, you’d be hard-pressed to find any Democrat in a competitive race running in support of the law.
Remember that when the left starts screaming that the Court is somehow going against the public interest. In fact, anything less than scrapping the entire law would be going against what the public wants. Today, a WSJ/NBC poll, which tends to juice its surveys to help Democrats, found that, by a 15 point margin, more adults would rather see the whole law scrapped than have it stand.
When Obama was inaugurated, Democrats had their largest congressional majorities in decades. They had a filibuster-proof majority in the Senate. The GOP, under Bush, had seemingly permanently tarnished their brand. Pundits at the time talked of a “permanent Democrat majority.” Even then, due to vocal public opposition, they almost couldn’t pass the bill. They had to resort to abominations like the Cornhusker Kickback, changes in congressional procedure and ramming through a 2,700 page bill before anyone had a chance to read it. Never in our nation’s history has such a far-reaching piece of legislation not received at least one vote from the minority party.
Remember that when the left yells that tomorrow’s action by the Court is merely some partisan act. When they shout that the Court is acting on behalf of “corporate interests”, remember the sweetheart deals the Democrats cut with the drug and health insurance industries to win passage of the bill. They bought off and had the support of virtually every corporation involved in health care. But, they couldn’t buy off the American public, and tomorrow the Supreme Court will speak for them.
The discontent on the left is palpable. They bet their dreams of a “permanent majority” on Obama and lost badly. They have encumbered the economy with so much policy uncertainty that the economy is stagnant and will likely give rise to another historic loss for the party in November.
If we’ve learned anything about Obama in the past three and half years, it’s that he doesn’t take defeat well. Neither he nor his allies on the left and in the media will be able to admit that they got health care so disastrously wrong. They cannot admit that their signature achievement is existentially unpopular with the voters. So, they, as always, will look for others to blame. It wasn’t some vague “partisan” or “corporate” interests that killed ObamaCare. It was defeated by Democrat hubris.
Tomorrow, Obama will kick off his reelection campaign, not against Romney, but against the Supreme Court. Democrats will attack not the GOP House, but judicial review and the very checks and balances that have sustained our Republic for more than 200 years.
Steel yourselves, patriots. It is a fight we absolutely must win.
